He stated again that “On the receipt of the prosecution`s final address, the first defendant filed a reply dated 13th June 2025 and I hereby adopt the reply on point of law as the first defendant’s answer to the issues raised by the first defendant’s final written address. Once again, we urge your lordship to discharge and acquit the first defendant and we want to add that the prosecution refunds the N19.5m paid to the EFCC so that she can pay the money back to the lenders,” he said In response, prosecuting counsel, Ekele Iheanacho, SAN informed the court of his final written address of January 10, 2025, filed the same date, served and adopted on June 16, 2025 and urged the court to convict the defendant as the prosecution has proved its case beyond reasonable doubt.     “We cannot continue to live by the 1999 Constitution, which haunts us as a military albatross,” Olanipekun said. “Let us borrow a golden leaf from other countries and agree to live together on acceptable terms and conditions.”

    He clarified that suspending the amendment process would not breed instability but would instead allow for sober national reflection.

    “By suggesting that the National Assembly stay action on any constitutional amendment for now, one is not advocating anomie,” he explained. “Rather, I propose a transition phase, between now and 2031, to reflect on the ills that have plagued our constitutions to date.”

    Olanipekun further called for a national referendum to determine Nigeria’s political and constitutional future, insisting that such a process represents the “unfiltered and undiluted voice of the people.”

  • Police, NBA to review Tinted permit policy.

    The Nigerian Bar Association’s Section on Public Interest and Development Law (NBA-SPIDEL) and the Nigeria Police Force have reached an agreement to review the policy on tinted permits.

    Prof. Paul Ananaba, Chairman of the NBA-SPIDEL, made this known in Ikeja on Thursday during an interactive session organized as part of the build-up to the NBA-SPIDEL Annual Conference in Akwa Ibom.

    Ananaba, a Senior Advocate of Nigeria, SAN, stated that the review aims to ensure the policy aligns with public interest and national security goals.

    The senior lawyer explained that the decision came after several weeks of discussions between both parties, following public complaints about the harassment of motorists with partially tinted vehicle windows.

    He noted that the association stepped in following numerous reports of arbitrary arrests and vehicle impoundments by police officers enforcing the tinted permit policy.

    “Following our discussions with senior police officers, we agreed that enforcement of the tinted permit should be suspended, while a joint review committee is constituted.

    “SPIDEL’s engagement with the police is not confrontational but aimed at promoting accountability and justice in public administration.

    “The committee, comprising representatives of NBA-SPIDEL and the Nigeria Police, will examine the legal and security implications of the policy and recommend new modalities for its regulation,” Ananaba said.

    The serenity of the Upper Sokponba Road axis of Benin City, Edo State where the state command of the Nigerian Drug Law Enforcement Agency (NDLEA) is located was on Friday morning shattered as passersby, traders, and motorists fled in different directions in confusion as operatives of the agency began to shoot sporadically as they pursued an articulated vehicle which was said to have hit their vehicle and refused to stop.

    Though the NDLEA had not made an official statement on the incident, a source who pleaded anonymity, however stated that the operatives eventually succeeded in apprehending the driver and had taken him into custody.

    It was gathered that the sporadic gunshots which lasted for more than five minutes at the gate of the Agency sent people running in different directions as the desperate driver raced towards Oka Market, which is about five hundred meters from the state command.

    The shooting was said to have started as the trailer approached the gate of the NDLEA where officers had already been alerted by their colleagues on its pursuit, deflating about seven of its tyres, while the driver kept moving.
    A reliable source explained that the driver brushed their vehicle somewhere along the way and refused to stop so that they could settle the matter hence the gunshots and deflation of the tyres of the vehicle to force the driver to stop.

    According to him, “It was a simple thing; they jammed our men, but the officers tried to stop him so that they could settle, but the driver refused to stop. That is why the men have been shooting to stop him. Even after bursting about seven tyres, he was still running, but we have caught him, and they are bringing him back to our office”.

Any citizen hara§§ed in the purported enforcement of the illegal tinted glass permit should contact any NBA branch.”

    He added that the Human Rights Committees of the association’s 130 branches are ready to provide pro bono services, warning that the police could extort up to N3bn monthly under the scheme.

    The NBA reminded the Inspector General of Police in a letter dated October 2, 2025, that the matter is already before the Federal High Court in Abuja (Suit No. FHC/ABJ/CS/1821/2025). The case challenges the legality of the Motor Vehicles (Prohibition of Tinted Glass) Decree 1991 and seeks to restrain the police from arrests, harassment, or extortion.

    NBA lawyer Godspower Eroga alleged that the police planned to divert proceeds into a private account instead of the Treasury Single Account, arguing the cited law sets no measurable standards for tinting and is incompatible with factory-fitted windows. He also noted that senior officers freely drive SUVs with dark tints.

    The NBA insisted the policy amounts to “taxation without legislation,” stressing that the police are not a revenue agency. It condemned the impoundment of Justice O. A. Ogunbowale’s vehicle in Asaba on the first day of enforcement, calling it “an embarrassing and avoidable situation.”

    The body lamented that its urgent application for an injunction was not heard due to court vacation, urging judges to act in public interest, “The judiciary’s authority and integrity are best protected when it prevents chaos, even if it means bending a procedural rule.”

    A fake lawyer simply identified as U.T Oghenetejiri was on Thursday arrested at the Magistrate Court, Orhunwhorhun in Udu Local Government Area of Delta State.

    The suspect, who appeared in a civil matter that was charged before the court, was apprehended by members of the Nigerian Bar Association, NBA, Udu Branch’s Anti-Fake lawyer Committee, led by David Omage and G. Fenfe, after he failed respond to a question posed before him by the magistrate in the courtroom.

    Instead, he took to his heels as court staff and lawyers chased him to the Orhuwhorun market where he was arrested.

    It was revealed that Oghenetejiri had been frequenting courts in the area for several months, allegedly representing clients under the guise of being a qualified legal practitioner.

    His inconsistent legal arguments and evasive answers about his law school background raised red flags.

    NBA Udu Branch Chairman, Edmund Odohisi, Esq, said the association had received prior complaints about an individual impersonating a lawyer and had launched a quiet investigation.

    “We took the matter seriously because the integrity of the legal profession is at stake,” Odohisi said.
