$6 Billion Mambilla Fraud: EFCC Witness Says Ex-Power Minister Agunloye Forged Contract Letter

A prosecution witness has told the Federal High Court in Abuja that former Power and Steel Minister Dr. Olu Agunloye forged a contract award letter in connection with the controversial $6 billion Mambilla Power Project.
The testimony came from Umar Hussein Babangida (PW3), an investigator with the Economic and Financial Crimes Commission (EFCC), during cross-examination by Agunloye’s defence counsel, Adeola Adedipe, SAN. 
Key points from Babangida’s testimony:
• The contract letter dated May 22, 2003, already tendered as an exhibit in court, is not genuine, according to investigation. 
• He described the document as “a false representation of itself,” claiming it contains “false information and misrepresentation of facts.” 
• Babangida said he did not compare the letter to another original because the one submitted was a certified true copy, but he believed it was fraudulently crafted. 
• Records from the Federal Executive Council (FEC) meeting of May 21, 2003 — obtained during the investigation — showed that 40 ministers, including Agunloye, were present, but no approval was given for the contract. 
• Babangida testified that he met with then-President Olusegun Obasanjo and then Attorney-General Kanu Agabi during the probe; both interviews were oral. 
• He also claimed there was no budgetary provision for the project at the time. 
• According to another witness statement, Obasanjo denied approving the contract in a certified letter. 
Agunloye denies the charges. He previously told the court that the EFCC was trying to damage his reputation through the allegations. 
The trial was adjourned to December 1, 2025, for the continuation of PW3’s cross-examination.
