Court Dismisses Nnamdi Kanu’s No-Case Submission, Orders Defence to Begin

Justice James Omotosho of the Federal High Court, Abuja, has dismissed the no-case submission filed by the lawyers of Nnamdi Kanu, leader of the Indigenous People of Biafra (IPOB). The ruling came after the Federal Government presented witnesses, evidence, and closed its case against the separatist leader.
Following the decision, Justice Omotosho directed Kanu to open his defence.
Kanu, who was brought to court on Friday under tight security by operatives of the Department of State Services (DSS), appeared alongside his legal team led by former Attorney-General of the Federation, Kanu G. Agabi (SAN).
Earlier this week, the court had rescheduled the hearing from October 10 to September 26 to rule on the no-case submission. The substantive terrorism trial is still expected to continue in October.
Separately, Kanu’s lawyers had earlier filed an application for his transfer to the National Hospital for urgent medical treatment, citing a life-threatening heart condition. The matter was adjourned earlier in September after Justice Musa Liman, sitting as a vacation judge, said his tenure had ended and directed the case be reassigned to Justice Omotosho.
The Federal Government, represented by Adegboyega Awomolo (SAN), had opposed the transfer request, while Kanu’s counsel argued they were not given sufficient time to respond to the government’s counter-affidavit.
Justice Liman, before handing over the matter, stressed the urgency of Kanu’s health concerns, noting they could be life-threatening.
