Trial on Hold as Abuja Judge Steps Back Amid NJC Petition Alleging Bias and Misconduct

Proceedings in the trial of two Abuja-based lawyers have been suspended after the presiding judge disclosed that a formal petition accusing him of misconduct had been filed with the National Judicial Council (NJC).

Justice Hamza Mu’azu of the Federal Capital Territory High Court adjourned the case following confirmation that the defendants, Barrister Maxwell Okpara and Barrister Gold Ogechi Nwankwo, had petitioned the NJC over alleged bias, hostility, and personal interest in the matter. The lawyers are facing a nine-count amended charge bordering on conspiracy, misrepresentation, and allegedly providing false information to the court in a garnishee proceedings case.

At the resumed hearing, Justice Mu’azu informed parties that although he was initially unaware of the petition, he has since responded and learned that the NJC had deliberated on it. He ruled that it was appropriate to await the council’s decision before continuing with the trial and consequently adjourned proceedings until February 10, 2026.

Speaking after the session, Okpara accused the judge of refusing to recuse himself despite repeated requests and alleged that the court had foreclosed his defence and acted in a manner he described as prejudicial. He further claimed that motions and affidavits raising concerns about the judge’s conduct were dismissed, while costs were imposed against him without any formal application.

The case has been marked by tense courtroom exchanges, including a previous sitting where Okpara openly accused the court of bias and declared that he could not receive a fair hearing. He has maintained that the judge’s continued involvement in the matter undermines confidence in the judicial process.

The adjournment has now placed the fate of the trial in the hands of the NJC, whose decision is expected to determine whether proceedings will continue under the same judge or be reassigned.
