Kanu Case: Why Section 98(3) Can’t Revive a Repealed Law and Nigeria’s Urgent Need for Legal Literacy

In this opinion piece, Njoku Jude Njoku, Esq. criticizes Justice James Omotosho’s conviction of Nnamdi Kanu under a law repealed in 2022, arguing that a dead law cannot legally sustain a 2025 conviction. He explains that Section 98(3) of the Terrorism Act only preserves past actions, not the repealed statute itself, and highlights Supreme Court precedents confirming that repealed laws cannot be revived. The article stresses that the judiciary’s misuse of legal language has forced Nigerians to become legally literate to protect themselves, calling Kanu’s case a turning point in public understanding of legal processes and judicial accountability.
