Clerk to National Assembly: Only Senate Can Decide Natasha Akpoti-Uduaghan’s Return

The Clerk to the National Assembly, Kamorudeen Ogunlana, has clarified that his office has no power to reinstate suspended Senator Natasha Akpoti-Uduaghan, who represents Kogi Central.

In a statement issued on Monday by the Director of Information, Bullah Audu Bi-Allah, the Clerk explained that his role is strictly administrative—supporting the Senate in line with its resolutions, standing orders, and the Nigerian Constitution.

“The Clerk’s Office does not have the authority to review, reverse, or interpret Senate decisions,” the statement read.

Akpoti-Uduaghan was suspended by the Senate on March 6 for six months over alleged “gross misconduct.” Although the matter was challenged in court, the Federal High Court did not overturn the suspension, and no binding order has been issued to lift it.

On September 4, Akpoti-Uduaghan notified the Clerk of her intention to resume legislative duties. However, the matter remains before the Court of Appeal, and Senate leadership has maintained that any change to her suspension must come through either a fresh Senate resolution or a clear court order.

The Clerk’s office also expressed concern over a petition from the senator’s lawyers accusing him of overreach and threatening legal action. Ogunlana stressed that he has acted strictly within the law and due process.

He emphasized that the decision on whether Akpoti-Uduaghan can return to the red chamber lies solely with the Senate:

“The determination of her resumption without a fresh Senate resolution or a definite court order is beyond the powers of the Clerk. The public is urged to remain patient and allow the appropriate institutions to carry out their constitutional responsibilities.”
