Ogun State Clarifies: Not Challenging EFCC Constitutionality in Supreme Court

The Ogun State Government has denied reports that it is challenging the constitutionality of the EFCC. Instead, the state is contesting NFIU's Financial Guidelines, which it says unfairly restrict the operations of states and local governments.

The Ogun State Government has refuted claims that it is questioning the constitutionality of the Economic and Financial Crimes Commission (EFCC) in the Supreme Court. Contrary to reports, the state clarified that its legal action focuses on the Nigerian Financial Intelligence Unit (NFIU)’s Financial Guidelines, which it argues unfairly restrict the operations of states and local governments.

Governor Dapo Abiodun's Special Adviser on Media and Strategy, Hon. Kayode Akinmade, explained that Ogun State is not involved in challenging the EFCC's constitutionality. He emphasized that the Supreme Court has already settled the matter, and Ogun State has no reason to revisit it.

The ongoing legal case (SC/CV/912/2024), which includes other states, is specifically aimed at challenging the NFIU’s guidelines that limit cash withdrawals by state and local governments. Ogun State contends that these restrictions disrupt governance and conflict with legal provisions.

Akinmade highlighted that Ogun State is primarily seeking to invalidate the NFIU’s guidelines, arguing that local governments should have unrestricted access to their funds without interference from bureaucratic regulations.
